Biography of Robert C. Martell
Robert (Bob) C. Martell was born and raised in Brooklyn, New York. After retiring from the U.S. Coast Guard as a Chief Petty Officer, he received his law degree from the University of New Hampshire (J.D. 2000). He obtained his Master's Degree in Admiralty Law from Tulane University Law School (LL.M 2002), where he served as a member of the Tulane Maritime Law Journal.
Bob was admitted to the New Hampshire Bar in 2000 and the Louisiana Bar in 2003. He is admitted to practice before the U.S. Districts Courts for the Eastern, Middle, and Western Districts of Louisiana, the U.S. Fifth Circuit Court of Appeals. During law school, Bob interned with the District Attorney's Office in Brooklyn, New York, and spent a few months with the Public Defender's office in Juneau, Alaska.
Upon graduation from law school, Bob practiced criminal defense work as both an investigator and defense attorney with the New Hampshire Public Defender's office. After graduating from Tulane, Bob spent three years with a mid-sized New Orleans maritime defense firm.
Quickly realizing that he was on the wrong side and not comfortable helping maritime insurance companies and employers avoid paying for their employees' injuries, Bob opened his own law practice where he helps injured maritime workers — both Jones Act Seaman and Longshoremen. Bob's practice also includes personal injury and criminal defense work. Criminal cases he has successfully defended over the years include murder, aggravated rape, assault, distribution/possession of controlled substances, and many others. He is currently a member of the Louisiana Bar Association, the New Orleans Bar Association, the Covington Bar Association, the American Bar Association, and the National Trial Lawyers Association.
Biography of Timothy F. Upton
Tim is a graduate of the University of Mississippi, where he earned a Bachelor's Degree in Business Administration. He received his law degree from Loyola University in 2000. Initially, he began his legal career representing insurance companies, including Allstate Insurance Company, Encompass Insurance Company, Imperial Fire and Casualty Insurance Company, Re-Insurance of America, and several others. During this period, he acquired a tremendous amount of trial experience and maintained an extremely high win ratio.
After spending this time representing large companies, Tim decided to direct his energy and experience toward fighting these companies on behalf of the individual. In mid-2004, Tim started The Upton Law Firm and has focused all of his attention on representing individuals with great success. He has a true passion for assisting the little guy against these large organizations. Tim's spectrum of legal services was broadened in 2004, and he began fighting for the rights of those charged with crimes by the federal and state authorities in Louisiana. He has an equal amount of success in this area of law as well.

Tim is currently admitted to practice in all state courts in Louisiana and federal court in the Eastern and Middle Districts of Louisiana. He is currently a member of the Louisiana State Bar, the New Orleans Bar Association, the Covington Bar Association, the American Trial Lawyers Association, the Louisiana Association for Justice, and the Louisiana Association of Criminal Defense Attorneys. His areas of practice are criminal defense, personal injury, and general civil litigation.
